For the first time in months, COVID-19 news took a back seat as the U.S. elections took center stage. With former Vice President Joe Biden having won the race to the White House, focus is now shifting to how the president-elect will approach the pandemic alongside the economic issues of the day. As we wrote here, with Republicans likely to retain control of the Senate, enacting substantial legislation will be a difficult task, and prospects for a large stimulus package have faded. The U.S. economy rebounded strongly in the third quarter, fueled by a large fiscal stimulus. Incoming data shows that the economy remains in need of additional stimulus. Without it, the economy could be in for a rough winter.

Jennifer Smith and Kalimah White Speak at Maryland State Bar Association Advance Estate Planning Institute
McCollom D’Emilio Smith Uebler LLC partner Jennifer Smith spoke Monday at the Advance Estate Planning Institute, part of the virtual Maryland State Bar Association’s Legal Excellence Week. Smith presented with Kalimah Z. White, a Senior Trust Advisor at TD Wealth. White holds over 14 years of Delaware trust experience, and offers her advice to high net worth individuals and institutional clients. Smith and White discussed the tax benefits of Delaware trusts, the availability of directed trusts, asset protections trusts, and various nonjudicial methods of trust modification with conferees. This is the first time Smith will present at MSBA’s Legal Excellence Week, which offers over 21 CLE credits in over 30 hours of learning on a virtual platform. The conference began November 9 and continues through the week.

At the Delaware State Bar Association’s annual Christopher W. White Distinguished Access to Justice Awards Ceremony, Potter Anderson was recognized for our pro bono work and charitable giving. We were honored to receive the Access to Justice Leadership Award for demonstrating outstanding leadership in the field of pro bono service to Delaware’s indigent population. We also received the United Way of Delaware’s Christopher J. Battaglia Award in the large firm category for the sixth year running for our support of the United Way of Delaware. Troutman Pepper Advisory: OCC, Federal Reserve, and FDIC Publish Paper Promoting Sound Practices for Operational Resiliency
On November 2, the Office of the Comptroller of the Currency, the Board of Governors of the Federal Reserve System, and the Federal Deposit Insurance Corporation (collectively, the Agencies) published a paper, “Sound Practices to Strengthen Operational Resilience,” to provide banks and their holding companies (collectively, institutions) with ways to minimize operational risks to institutions’ resiliency that can cause extensive disruptions. Operational resilience, as defined in the paper, means “the ability to deliver operations, including critical operations and core business lines, through a disruption from any hazard. It is the outcome of effective operational risk management combined with sufficient financial and operational resources to prepare, adapt, withstand, and recover from disruption.”
